If the Property is unoccupied and the Seller does not file the Notice as required in Section 1(a), the following events occur: a. The Seller is liable for the full fair market value of the Purchase Price, plus Seller's costs, but no cash proceeds other than this Seller receives under the sales contract or otherwise as consideration for the Sale. b. Seller pays the proceeds of the sale using cash, money orders or credit cards (unless the property was originally sold for cash at a public auction), but Seller receives no cash or other consideration directly. The Purchaser has authorized a third party to act as its agent in connection with the Purchase and any taxes and fees, but the fact the property is owned by the purchaser does not change the right, obligation or requirement of the Purchaser to receive that agent\'s name and complete contact information. 2. If the Property is occupied, how long (in the absence of the sale of the property) has the property been occupied by Sellers and/or Sellers' agents? a. The property was occupied immediately prior to the commencement of Sellers or Sellers', agents\' or employees\' ownership and occupancy of the property. If the Purchaser does not find a written statement from the Owner or Seller confirming its possession of, or possession of a legal right to, the Property, the Purchaser must request it from Seller or the Seller. b. The Property was occupied in the past for a period exceeding one month. If the Owner does not have a current lease or rental agreement or other written confirmation from its lessee or tenant of the continued occupation of, or possession with the permission of its tenant, the following events occur: a. Any interest in and/or possession of the property passes directly to the Purchaser if the Purchaser obtains possession or control of the property with notice to the lessee/tenant. b. The lessee/tenant of the property gives written notice to Seller or the Seller that the lessee/tenant has abandoned or taken possession of the premises or any part of the premises as of the date of the notice. If the property was previously owned by a lessee/tenant, the lessee/tenant of the property may revoke its right to possession or control of the property in writing dated within the preceding six months specifying the date that the notice was served and the grounds for the revocation.
